Why we founded Bankruptcy Recovery Group

We founded The Bankruptcy Recovery Group because, in our collective experience, collection of avoidance-based recoveries had become an inefficient process — often pursued too late in cases and through a formulaic approach. Bankruptcy Recovery Group addresses these issues by providing a more holistic and individuated approach to avoidance-based recoveries.

Years of practice have taught us that engaging an avoidance recovery team early in Chapter 11 cases not only simplifies the plan and plan negotiation process but leads to higher estate recoveries. Early engagement provides invaluable data for the estate that can be used in plan negotiation and sale processes. Too often Chapter 11 estates leave money on the table by failing to adequately recognize the value of their avoidance claims, simply electing to "leave the claims for the liquidating trust."

The same approach now extends beyond Chapter 5. We prosecute insurance bad faith and other fiduciary claims for trustees, debtors, and other fiduciaries on the same contingency-fee basis — bringing the same analytical rigor and senior-counsel attention to common law and statutory claims that we bring to avoidance work.
